Carry on Church Premises

Ok, in CHL training (and I think on this site) I have learned it is permissible for a CHL holder to carry in a church/place of worship.  However, on the Texas DPS website (http://www.dps.texas.gov/RSD/CHL/faqs/index.htm, question #34) and the referenced Penal Code 46.035 (http://www.statutes.legis.state.tx.us/D ... htm#46.035) both seem to state otherwise.  I would LOVE some clarification on this.  :)  Thanks.

Keep reading the rest of it.  There was a later amendment that required churches (as well as hospitals, amusement parks and government meetings) to post 30.06.  Church is good to go if there is no 30.06 (or other effective notice).

(i)  Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.

Yes, your CHL instructor is correct. It is permissible for a CHL holder to carry at any church or other place of religious worship. If the place of religious worship wants to exclude CHL carriers, then it must post a 30.06 sign. This is stated in 46.035(i).

Superb.  Thanks.  I didn't read the full text.  I'm not sure why the DPS website didn't include qualifiers like 30.06 in their FAQ section.  Strange.

My church does not prohibit the carrying of a concealed weapon. However, during the week a private school uses some of our church facilities. While this school conducts their activities, normal church activities are being conducted in other rooms of the same building which is used by the private school. Can I as a legal CHL holder carry my concealed weapon into this church building while I attend normal church activities during the time the school is in session?

In this situation, we have to look to the use of the building. If the building at that point in time is being used as a school, it is considered an educational institution. Therefore, you may not carry into that building.

On the other hand, if the building is not being used for any school activities, then you are perfectly fine in carrying your concealed handgun into the building.
