Museum felony notice, no 51%, no 30.06
« on: August 01, 2015, 04:58:39 PM »
I visited the Kimbell Art Museum in Fort Worth today and noticed that they had this notice posted by both of their building entrances: "FELONY NOTICE: The licensed or unlicensed possession of a weapon on these premises is a felony with a maximum penalty of 10 years imprisonment and a fine not to exceed $10,000." Now, this happens to be the exact wording of a 51% sign, but they do not have any actual 51% signs posted. I also find it very unlikely that the museum derives 51% of proceeds from alcohol sales. They also do not have any 30.06 signs posted anywhere that I could see. This seems to be a completely invalid notice. Am I right?

my 2 cents is, "carry on". Concealed is concealed.

I guess they have something to cover up by using this kind of information. Hopefully, the data was outdated rather than what I have guessed. ;)

That's a shame.  I'm a patron of the Kimbell. I'll have to tell them how I feel about it, before bidding them farewell.  As a CHL holder:
1. I've been thoroughly vetted and cleared by State and Federal background inquiries.
2. Never been convicted of a crime.
3. I don't do drugs.
4. Never been the subject of a restraining order.
5. I'm not under criminal indictment
6. I'm not a fugitive from justice.

I did hurt somebody's feelings once...but that's still more than probably could be said about many of the Kimbell's own staff, and most of its current patrons.

This concerns me, as I am also a member at the Kimbell. I did not notice that sign the last time I was there, but it has been a while. I can't imagine that they actually derive half their revenue from alcohol sales, but if they do they should have a proper sign not just the verbiage. I will definitely look for this next time I am out that way. From your description, it does not sound like legal notice to me. It sounds like they just copied the wording from a 51% sign as scare tactics for people that don't know better. Anyone know if there is a way to look up whether a given business actually gets 51% of it's money from alcohol sold by the glass?

You can check an entity's license status on the TABC website http://https://www.tabc.state.tx.us/licensing/ and then click "Public Inquiry" at the top of the page.  From there you will enter the business' name, address, etc. and it will tell you the status.

Blue = not a 51% location
Red = 51% location

Best bet is to NOT "guess" - post this inquiry in the "Ask the Lawyers" section....................

You might want to notify TABC that the museum has co-opted the language from their 51% sign. I saw a store that had done basically the same thing in Austin, presumably to keep CHL holders out. They could have posted a 30.06 sign and been done with it, but for whatever reason, ignorance of the law most likely, made-up their own sign. I called the TABC headquarters, told them I am a CHL holder, and asked if the store sells alcohol. I was told it does not. I then let TABC know that while it was fine if the store wanted to post a 30.06 sign, it was confusing to me as a CHL holder who always strives to be 100% compliant with the law to see that language on a sign at a store of that type. TABC said they would look into it. I passed the store a couple of weeks later and the sign was gone. Interestingly it wasn't replaced with a 30.06 sign.
