Class 3 trust post 1986
« on: July 22, 2014, 01:09:38 AM »
I am looking into setting up a trust to buy a fully automatic class 3 firearm and I have a couple of questions. 1) Is it possible to set it up with more than one person ? I would want to set it up so I own the firearm and my two sons as co-owners.  2) Does setting up a trust allow you to buy fully automatic firearms made post 1986?

In answer to your first question, the trust in the actual owner of the firearm and you would be allowed to possess it as the trustee. Your sons could be co trustees on the trust. Therefore all three of you would have equal access to possess and use the machine gun. In response to your second question, just because a trust is set up to own NFA weapons, does not allow it to own, or its trustees to possess, a machine gun manufactured after May 19, 1986.  These machine guns are prohibited to all civilians whether or not they are actual persons or other legal entities.

Thanks for the great question. Hope this helps.
