Retired Peace Officers, Open Carry w/No CHL

Since TPC (Texas Penal Code) 46.15 exempts retired Peace Officers from TPC 46.02 and 46.03 allowing retired Peace Officers to carry can they open carry without a CHL. Since they are not required to obtain a CHL to carry CHL laws do not apply to anyone who does not have a CHL. It would seem reasonable they be allowed to open carry in the State of Texas since they are exempt by TCP 46.15 which does not mandate how they may carry a firearm. In speaking to several prosecutors they are in agreement, but give the standard disclaimer about not being allowed to provide legal advise. Also, I have spoke to several criminal defense attorneys who say the same.

Any thoughts from Texas Law Shield.

As long as you comply with all the requirements in 46.15(a)(5), there is nothing in the statute that would differentiate your ability to carry concealed from being able to carry openly.
