51%, gun shows and livestock shows in county owned building
« on: February 01, 2016, 01:18:34 PM »
I have question regarding posting and carry at a county owned building.  The Richard M Borchard Fairgrounds in Robstown is posted 51%.  How can a 51% location also host a regular gunshow (Saxet)?  The fairgrounds is also host to the Nueces County Junior Livestock Show.  The show is not sponsored by a school but school clubs (FFA) compete there as well as non school clubs(4H).  Alcohol is served during the show and especially during the sale.  The buildings were all posted 30.06/30.07 during the show.  Not sure if was just for the duration of the show as the signs were taped to the doors.  Can they legally post this event?  I have a hard time believing it would qualify as a school sponsored event considering alcohol is served during the event.

roadkill,

At this point, you should contact the Richard M Borchard Fairgrounds directly to determine their justification for each sign and how they explain hosting a gun show on premises with a 51% posting.
With regards to the livestock show, the issue is not whether this is a school sponsored event under TPC 46.03, but whether there is an interscholastic event taking place, as this would be a premises that is prohibited under 46.035(b)(2). There is an exception to the rule that property owned or leased by a governmental entity cannot post 30.06 and 30.07 signs, when the premises is separately covered under 46.03 or 46.035.

roadkill,

Section 46.035 does not define “interscholastic event” as it is used in that section of the Penal Code.
