30.06 and 30.07 signs at gas stations
« on: February 03, 2016, 05:42:43 AM »
If this has been covered already, I missed it.  I'm seeing many gas stations putting up 30.06 and 30.07 sign on the doors of their stores/ cashiers buildings.  I know this means you can't carry inside the buildings; but does that mean you can't carry while pumping gas at the pumps too?  Self serve lets you pump gas without ever entering the building.  I guess this is the old premises vs. property issue.

Since the search tool doesn't seem to work very well, here's the link.

yabu,

Unfortunately, this is a bit of a gray area at the moment as there is little to no case law on 30.06 and 30.07 notice. Be advised that unlike other provisions in the Penal Code, these sections use the word “property” instead of “premises” and thus could cover the entire property as opposed to only applying to the buildings themselves. Please call in to speak with one of our attorneys for more clarification.
