30.06 and 30.07 signs in Apartment Driveway
« on: January 29, 2016, 02:50:38 PM »
My apartment complex just posted 30.06 and 30.07 signs in the entrance to the complex as soon as you turn off the main road. It's nowhere near any of the buildings, including my own or the building with the sales office. What does this sign mean for me (I live in a different building) as well as those who live in the same building as the sales office? Also, they spelled license wrong, which I supposed technically makes the sign invalid anyways.

exbellicus,

Unfortunately, this is a bit of a gray area at the moment as there is little to no case law on 30.06 and 30.07 notice. Be advised that unlike other provisions in the Penal Code, these sections use the word “property” instead of “premises” and thus could cover the entire property as opposed to only applying to the buildings themselves. Please call in to speak with one of our attorneys for more clarification.
