FL Question: Immunity Hearings Under FS 776
« on: June 12, 2017, 08:32:26 PM »
Despite the new law signed by Gov. Scott regarding FS 776.032(4) putting the burden of proof on the state, is it not true that the prosecution can refuse the defendant an immunity hearing and proceed directly to trial?  Isn't this what happened to George Zimmerman?  I don't believe he was ever granted an immunity hearing.

Thanks!

sacvet,

No the State cannot prevent you from having an immunity hearing.  In the Zimmerman case, the defense elected not to have a hearing for strategic purposes.
