question regarding tpc 30.05
« on: April 17, 2014, 06:18:37 PM »
Hello, I just read through the texas version of knowing the law of deadly force. It seems as though it's saying that the posting of a tpc 30.05 sign would mean it's illegal for a chl holder to carry in that business.  I know the requirements of a 30.06 sign, but if the 30.05 sign is legal, what requirements does it have regarding posting?

Dear Asbandr,

A 30.05 sign pertains to criminal trespass in general, not keeping a concealed handgun holder from carrying on the premises. The sign itself provides notice that you are not allowed on the property without effective consent. Any business that posted a 30.05 sign would not have very many customers.

This sign comes up more with private property or expansive ranches where people post signs or paint purple lines on trees to indicate that the property is private and not to be entered into. If you are allowed on the property, a 30.06 sign is required to keep your handgun out if you are a CHL holder, whereas the 30.05 sign keeps you out entirely.

Thanks for the question. Hope that helps.
